Negligent Truck Driver Asks for Leniency

The Indiana truck driver blamed in a fatal accident that killed five bus passengers returning from a band competition is asking for leniency on charges of falsifying his driving log.

Michael Kozlowski is awaiting sentencing from U.S. District Court Judge Barbara Crabb on five counts of using a trucking log that contained false entries. Kozlowskis attorney asked the judge to impose a probation sentence rather than prison time.

According to his log, Kozlowski said he was sleeping or resting in his truck on five days in 2005 when evidence shows he was driving.

Kozloskiw fell asleep at the wheel and his rig overturned after he swerved back onto I-94. A bus carrying a high school band crashed into the truck, killing 5 and injuring 28.
