Truck Barrels Into Oncoming Traffic

WAUSAUKEE, WI Attorney Richard Kalkhoff, of Pitman, Kalkhoff, Sicula & Dentice, S.C., won a $125,000 settlement on behalf of Wausaukee man involved in a truck accident in Marinette County.

On November 18, 2005, the Plaintiff, a 42-year-old male, was navigating a curve on Highway 180 in Marinette County when the driver of an oncoming Ford F-150 lost control of his vehicle after veering off the roadway and onto the shoulder. According to Police reports, the Defendant approached the curve at too shallow of an angle allowing the vehicles wheels to hit the gravel and snow on the shoulder of the road. The Defendant lost control of the large truck, over corrected and slid sideways into the path of the Plaintiff.

As a result of the accident, the Plaintiff suffered a concussion and inner ear imbalance. The defense counsel fought both the coverage and damages in the claim by arguing that the driver of the Ford F-150 was using a company vehicle for personal use at the time of the accident and by questioning the severity of his injuries after sending the Plaintiff to two (2) insurance medical examiners. Despite the defense counsels efforts, Attorney Kalkhoff won both arguments.

The lawsuit was filed in Circuit Court of Marinette County.
