In May 2020, Country Villa Assisted Living Facility in Pulaski, Wisconsin had an outbreak of COVID-19. During that outbreak, 10 of the residents who contracted the disease later died. Now, three of the families who lost their loved ones during this outbreak, including a husband and wife couple, are suing the facility and its insurance company for negligence.
According to a 2 First Alert news report, PKSD attorney Kate Metzger represents the families in this case. These plaintiffs claim the deaths of their loved ones could have been prevented had Country Villa taken proper precautions.
During the outbreak at Country Villa, 28 of its 36 residents contracted COVID. Ten of those infected later died. That is close to 30 percent of Country Villa’s total resident population. Family members of the deceased say that their loved ones were in good health prior to being infected with the virus.
Kate Metzger shares more about the case, but, at the request of the families, does not identify them by name. According to the plaintiffs, “there was no plan” to prevent an outbreak or protect residents if an outbreak occurred. According to the families, by the time the facility made any attempt to control the infection, it was too little and too late.
According to the lawsuit complaint, Country Villa continued to hold community gatherings, disregarding the use of personal protective equipment (PPE). The facility also ignored precautions and recommendations set by the Centers for Disease Control and Prevention (CDC).
Kate Metzger said that the likely reason other long-term care facilities around the state fared better is because they followed the CDC’s guidelines.
In the end, state regulators fined the facility $7,600 for violations. According to Metzger, however, this lawsuit is not about seeking a specific dollar amount, but rather holding the facility accountable for its negligence. Additionally, the focus is to help improve the safety of current and future residents.
