Records from a Toledo, Ohio, federal court reveal the manufacturer is extending the deadline for filing a claim for compensation in response to concern from patients who were ineligible for the initial settlement. Those who received a DePuy ASR implant after Aug. 31, 2015 and were previously ineligible for the $2.5 billion settlement now have the opportunity to seek damages for the pain and suffering they endured and the medical costs they incurred.
Representatives for DePuy say that each of the 1,400 eligible patients will receive approximately $300,000 in damages.
In August 2010, Johnson & Johnson recalled 93,000 of its ASR hip implant devices due to a high failure rate. Patients reported experiencing a failure rate of up to 44% within five years of surgery and metal poisoning due to the devices design, among other complications. The implants were supposed to last up to 20 years without issue.
In 2013, Johnson & Johnson attempted to settle all pending claims in one blow, but plaintiffs were only eligible if they received an implant before Aug. 31, 2013. The extension honors the terms of the original accord but recognizes those who received an implant before Jan. 31, 2015.
