Injury attorney Richard Kalkhoff, of Pitman, Kalkhoff & Sicula S.C., won a settlement on behalf of a Sheboygan family whose toddler was strangled by a defective mini-blind cord sold at a Menards hardware store.
On April 16, 2003, the Plaintiffs mother had just laid the 14-month-old toddler down for his afternoon nap when the pull cord of a mini-blind became entangled around the toddlers neck strangling him to death.
The lawsuit was filed in Circuit Court of Sheboygan County and alleges that the defendants were negligent in allowing the mini-blind to be sold with a tasseled pull cord in excess of 7 1/4 inches in length, posing an unreasonable risk of cord strangulation. The lawsuit further alleges that manufacturers failed to warn regarding the risks of cord strangulation and were negligent in failing to take adequate measures to recall the known defective products.
The Plaintiffs settled with the manufacturer and against Menards, the retailer. The terms of the settlement were not disclosed. Attorney Kalkhoff was co-counsel with a St. Louis personal injury law firm during this case.
