The first nursing home death occurred at Seacrest House on Nov. 20, 2014, when a resident who had a seizure disorder drowned in a bathtub. The coroner’s report noted that the drowning may have been preceded by a seizure.
The resident was alone and the door to the room with the bathtub was closed, even though staffers were under orders to supervise him at all times because of his seizure disorder and other health problems.
The AG’s office charged the two staff members who were on duty at the time with criminally negligent homicide of an at-risk adult. One of the staffers was also charged with manslaughter.
The second death occurred on June 15, 2016, when a resident with advanced dementia at Ashley Manor Assisted Living Facility suffered heat stress after an outdoor fall into a landscaping rock bed. She lay there for approximately an hour and a half before she was discovered.
A review of video surveillance of the area revealed that staff members did not check on the resident for about three hours, including the time she was laying on the rock bed after her fall.
The three staff members responsible for doing headcounts were all charged with criminally negligent homicide of an at-risk adult. One was charged with tampering with evidence and another was charged with attempting to influence a public servant.
