Doctor’s Orders Not Followed, Man Loses Leg

Jeffrey Pitman – a Milwaukee injury lawyer and partner at the law office of Pitman, Kalkhoff, Sicula & Dentice, S.C., filed a lawsuit on behalf of a Milwaukee man who had to have his leg amputated after nurses failed to treat him at a local nursing home.

The resident, a 74-year-old male, was admitted to Marian Franciscan Center with moderate risk for pressure sore development and that he would be slow to heal if a pressure sore should develop. The residents care required that he be repositioned every two hours while lift suspension boots were to be used to avoid applying pressure on affected areas of his heels.

A state investigation shows that despite a physicians order to wear the protective boots, the nursing staff did not utilize the boots initially. Instead, the investigation showed that the nursing staff allowed the resident to wear shoes and socks until his feet swelled to the point that they could no longer fit into them. Because the doctors orders were not followed, the resident developed a pressure sore on his right heel. The residents sore became infected and continued to worsen until a doctor ordered the amputation of his right leg above the knee.

The lawsuit alleges that Marian Franciscan and its staff failed to monitor, assess, and ensure that the Plaintiff received the necessary services to keep him safe. They failed to employ and implement appropriate and necessary nursing and wound care prevention and they failed to provide adequate supervision, training and instruction to the nursing staff to ensure that the resident received proper care.
