A 70-year-old Iowa licensed practical nurse, Becky Sue Manning, has entered an Alford plea in connection with the death of a nursing home resident at Fonda Specialty Care. What this means, is that while not admitting guilt, Manning has acknowledged sufficient evidence exists to prove wanton neglect – a serious charge indicating a conscious and reckless disregard for a resident’s health and safety.
Manning faces up to two years in prison and potential fines of $8,540. Sentencing is scheduled for January 2025.
Marvin Jacobs, an army veteran know to many as “Pete,” required specialized medical care. He had undergone a tracheostomy, which created an opening in his neck for breathing. However, because his airway frequently became clogged, facility staff maintained a suctioning machine at his bedside. This machine provided the means for immediate intervention when needed. Since Pete’s airways frequently became clogged, ongoing suctioning of his airway was essential for his daily care and survival.
On February 19, 2023, Pete showed clear signs of respiratory distress while sitting in his recliner. According to a recent news article, staff members observed Pete pointing at his neck, gasping for air, and silently mouthing that he was unable to breathe. No fewer than four workers alerted Manning to the emergency and requested immediate suctioning of his airway. Despite these repeated and urgent requests, Manning allegedly refused to provide care, claiming she had been told she would not have to handle tracheostomy duties.
